Letter from Bartolomé de Cartagena to Teresa de Saavedra y Zúñiga, countess of Villalonso.

The author asks the countess to be absolutely honest about what she needs a loan for, since it is a large sum of money and it may be risky for both of them.

In 1623 Juan de Cartagena, Bartolomé de Cartagena´s son, appealed to the Council of Castile against Teresa de Saavedra y Zúñiga, countess of Villalonso, for non-payment of a debt of 7000 ducats plus the interests. The aforementioned debt was contracted in 1599 to enhance the dowry of the Counts´ daughter. In 1603, Teresa de Saavedra renegotiated the clauses in order to postpone the payments. However, the financial obligation contracted by Villalonso was never fully satisfied and therefore Juan de Cartagena, as Bartolomé de Cartagena´s heir, brought the case to Court. Teresa´s defence was based on two core issues: her being a woman, which invalidated her to handle economic matters; and the fact she depended on her husband. She alleged she had no choice but to contract her husband´s economic responsibilities. Given the defendant and her creditors attempts to delegitimize Juan de Cartagena´s arguments, he presented several documents proving Teresa de Saavedra´s active role in asking for the loan to Bartolomé de Cartagena. First of all, several letters written by Cartagena, Teresa and Luis de Castilla were presented. These letters showed the agreement they made and despite the fact that there was sufficient notarial certification to prove Teresa´s awareness of her obligations, the plaintiff continued presenting written testimonies and almost a hundred letters of over two decades of correspondence between the countess and Bartolomé de Cartagena were attached to the proceeding documentation. In the aforementioned letters, economic and family matters were discussed, together with the news from the courts of Felipe II and Felipe III. The proceeding is incomplete and there is almost no information about the process or the sentence; however, we know that Teresa de Saavedra identified the letters.

A la Condesa de Villalonso q dios gde muchos años

Crea VS que yo la desseo tanto servir y con tan particulares obligaciones al Conde, q hare mas que lo possible supuesto q vengo a persuadirme lo que VasSas me dicen les importa para el estado de sus cosas y que les va la honra en poderse socorrer d estos siete mill ducados pero como yo no los tengo sobrados y el menor daño ha de ser tomarlos a tributo quando vaya a Sevilla y segun la vigente necessidad si es aqui ha de ser a cambio siento mucho q la seguridad no sea muy bastante y mucho mas el no poderse poner en cabeza de anbos hijos dando ocho mill ducados porq con eso paresçe que se cuenta grabamenes y que era mas lo que se pedia si huvieran de faltar anbos dios los gde y decir q se redimiran, no ay q hablar en ello ni que se me pagara el excessivo gasto del canbio q por la presuridad del conde havra de estar que como son qtas con diez no se puede armar çancadilla, y de esa manera no seria licito sino contracto usurario, y assi visto q en una cosa q no estara mal a mis hijas se haze tan notable servicio a vassas segun tanbien el sor don luis de Castilla me lo ha affirmado refiriendome tanbien quanto vs se lo ha encarescido y el Conde por su parte, yo me resolvere de buscarlos cuesten lo que costaren y con los que tengo aqui en reales dar a vassas los siete mill ducados, y no se si los ponga en cabeça de ju y de herdo u de herdo solo pero no lo hare por lo que es satisfacion mia hasta q puedan dar a VS este muy a solas el pe franco anto su confessor u otra persona, y que VS sin dar parte al conde ni a otra persona me diga con pura sencillez y verdad si es tan importante y necessa la necessidad q se me representa y tan de gusto y voluntad de VS como ha publicado VS y dichome a mi y al sor don luis que algunas veçes las señoras por el gasto de sus maridos y mas VS que con tantas raçones quiere y estima al suyo hazen cosas semejantes q dessearian escusarlas y pues esto sera tan facil con solo dejarlo de dar ya que no ha de haver en este tiempo quie quiera aventurar tanto vs me lo diga con la llaneza y verdad que meresçe mi desseo y voluntad y lo que yo he desseado siempre servir al conde y lo que en todas ocayziones he hecho y dios gde a VS con el augto de estado que yo desseo de la posada 20 de xbre de 1599
